1. Acceptance of Terms
By accessing the KCBON website or using any of our services — including web development, eCommerce solutions, web hosting, domain registration, and SSL certificates — you agree to be bound by these Terms of Service (“Terms”). If you are entering into these Terms on behalf of a company or organization, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you must not use our services.
2. Description of Services
KCBON offers the following services:
- Web Development: Custom website design and development for businesses, personal brands, and eCommerce stores, including responsive design, CMS integration, and ongoing maintenance
- eCommerce Solutions: Online store setup with product catalogs, shopping carts, payment gateway integration, and inventory management
- Web Hosting: High-performance hosting plans (Starter, Professional, Enterprise) with SSD storage, SSL certificates, daily backups, and CDN integration
- Domain Registration: Domain name search, registration, transfer, and renewal services
- SSL Certificates: Provisioning and management of SSL/TLS certificates for secure connections

3. Client Responsibilities
As a client of KCBON, you agree to:
- Provide accurate, complete, and timely information required for service delivery, including content, brand assets, and project requirements
- Review and provide feedback on deliverables within agreed-upon timeframes
- Maintain the confidentiality and security of your account credentials
- Ensure that all content you provide for your website does not infringe on third-party intellectual property rights
- Comply with all applicable local, state, federal, and international laws
- Not use our hosting services for illegal content, spam, malware distribution, or any activity that violates our Acceptable Use Policy
- Not attempt to gain unauthorized access to our servers, systems, or other clients’ data
4. Project Process & Timelines
Our web development process follows four phases:
- Consultation: We discuss your goals, requirements, and vision during an initial discovery session
- Design: We create wireframes and visual mockups for your approval before development begins
- Development: We build your site with clean, performant code, providing staging previews for review
- Launch & Support: After final approval, we deploy your site and provide post-launch support
Project timelines are estimates and depend on timely client feedback. Delays in providing content, assets, or approvals may extend delivery dates. Significant scope changes after project kickoff may require a revised quote and timeline.
5. Payment Terms
- Web development projects: A 50% deposit is required to begin work. The remaining balance is due upon project completion and before final deployment
- Hosting services: Billed on a recurring basis (monthly or annually) as selected at signup. Annual plans receive discounted pricing
- Domain registration: Fees are due at the time of registration or renewal
- Late payments: Invoices unpaid after 15 days may incur a late fee of 1.5% per month. Services may be suspended after 30 days of non-payment
- Refunds: Hosting fees are non-refundable for the current billing period. Web development deposits are non-refundable once work has commenced. Annual hosting plans may be eligible for a pro-rated refund within the first 30 days
6. Intellectual Property
- Client ownership: Upon full payment, you own all custom designs, content, and code created specifically for your project
- KCBON ownership: We retain ownership of proprietary tools, frameworks, boilerplate code, and pre-existing components used across multiple projects
- Third-party assets: Stock images, fonts, plugins, and third-party integrations remain subject to their respective licenses
- Portfolio rights: Unless otherwise agreed in writing, KCBON reserves the right to showcase completed projects in our portfolio and marketing materials
7. Hosting & Uptime
- We target 99.9% uptime for all hosting plans, backed by enterprise-grade infrastructure with redundant systems
- Scheduled maintenance will be performed during low-traffic windows with at least 48 hours’ advance notice when possible
- We are not liable for downtime caused by DDoS attacks, force majeure events, client-side code errors, third-party service outages, or circumstances beyond our reasonable control
- Daily automated backups are included with Professional and Enterprise plans. Backup restoration may incur a service fee on Starter plans
8. Acceptable Use Policy
You may not use KCBON hosting services to:
- Host, distribute, or link to malware, viruses, or malicious code
- Send unsolicited bulk email (spam) or engage in phishing
- Store or distribute pirated software, illegal content, or content that infringes on intellectual property rights
- Conduct activities that consume excessive server resources to the detriment of other clients
- Host adult content, gambling services, or any content prohibited by U.S. law
Violations may result in immediate suspension or termination without refund.
9. Limitation of Liability
To the maximum extent permitted by law, KCBON shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total aggregate liability for any claim shall not exceed the total fees paid by you to KCBON in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless KCBON, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.
11. Termination
- By you: You may cancel hosting services at any time with 30 days’ written notice. Web development projects may be cancelled subject to payment for work already completed
- By KCBON: We may suspend or terminate services immediately if you violate these Terms, fail to pay after notice, or engage in activities that harm our infrastructure or reputation
- Effect of termination: Upon termination, your access to hosting services will cease. We will provide a 15-day grace period to download your data unless termination is due to a Terms violation
12. Warranties & Disclaimers
KCBON provides services “as is” and “as available.” We make no warranties, express or implied, regarding merchantability, fitness for a particular purpose, or non-infringement. While we strive for excellence, we do not guarantee that our services will be uninterrupted, error-free, or completely secure.
13. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be settled through binding arbitration administered under the rules of the American Arbitration Association. Each party shall bear its own arbitration costs.
14. Modifications
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on our website at least 30 days before taking effect. Continued use of our services after changes become effective constitutes acceptance of the revised Terms.
